Terms and Conditions of Sale – PURE by Jasaco

• The present terms and conditions apply to all sales contracts to which we agree. These conditions are always deemed to have been formally and explicitly accepted by the customer.
• Deviations from the present general terms and conditions of sale cannot be invoked against us without our prior written consent.
• Delivery dates are provided for information purposes only. The indicated timeframes are approximate and not binding. Under no circumstances shall delays give rise to cancellation of the order or to any claim for damages, unless expressly agreed otherwise by us in writing. Delivery periods only begin once we are in possession of all necessary information. Proposed delivery dates may be cancelled or postponed by us in the event of non-payment on the due date for any other delivery of goods.
• Unless otherwise agreed in writing, our method of payment is always by pro forma invoices.
• Any amount remaining unpaid on the due date shall, without further notice or formality, bear interest at the rate applied by the National Bank of Belgium at the time of invoicing for current account advances on government securities, increased by 2%.
• In the event of non-payment of an invoice on the due date, we reserve the right to increase the invoice amount by 10%, with a minimum surcharge of €50.
• Failure to pay even a single invoice on its due date shall, without further notice, render the balance of all other invoices immediately due and payable, including those not yet due.
• In the event of non-fulfilment of its obligations, the transaction shall be terminated without further consideration or formal notice, without prejudice to our right to claim all damages and interest. The seller’s intent shall be sufficiently demonstrated by the sending of a registered letter.
• THE SELLER RETAINS OWNERSHIP OF THE GOODS UNTIL FULL PAYMENT HAS BEEN MADE. Risks are borne by the buyer. Advance payments shall be retained by the seller to cover any potential losses in the event of resale.
• The mere issuance and/or acceptance of bills of exchange or other negotiable instruments does not constitute a substitution of the debt, nor does it release the buyer from the present terms and conditions of sale.
• In the event of disputes, only the courts of Leuven or the courts of the buyer’s place of residence, at the seller’s discretion, shall have jurisdiction.
• Payments made to third parties are not recognized.
• We expressly refuse to accept any liability for damage to persons or property resulting from a defect in any of our deliveries of goods.
• To be valid, complaints regarding the goods must be submitted within eight days of receipt. Complaints must be sent by email, including photographic evidence, to info@jasaco.be. Items from the SALE/OUTLET section are not eligible for return. Returns are only accepted for damaged goods.
• The mere submission of a complaint does not entitle the buyer to delay or refuse payment on the due date.
• Privacy Statement: Your personal information is processed by Jasaco NV (PURE by Jasaco) – Europaweg 10 – 3560 Lummen – 011/45.03.20 – info@jasaco.be, for customer management purposes based on the contractual relationship resulting from your order/purchase, and for direct marketing purposes (to offer you new products or services) based on our legitimate interest in entrepreneurship. If you do not wish for your information to be used for direct marketing, please let us know via info@jasaco.be. At this address, you can also request details about the data we process about you, and you may ask to have it corrected, deleted, or transferred.
